TERMS OF SERVICE

These Terms of Service govern your use of the Dorifab Motorsport website and purchases made through our online store.

Throughout these terms, “Dorifab”, “we”, “us” and “our” refer to Dorifab Motorsport.

By accessing our website, purchasing a product or otherwise using our online store, you agree to these Terms of Service together with any policies referenced on the website.

If you do not agree to these terms, you should not use the website or place an order.

1. ONLINE STORE

Our online store is operated using Shopify.

You must not use the website or our products for any unlawful purpose or in a way that infringes the rights of Dorifab or another person.

You must not attempt to interfere with, damage, compromise or gain unauthorised access to the website or its systems.

2. PRODUCT INFORMATION

We aim to provide accurate product descriptions, specifications, compatibility information, photographs and pricing.

Motorsport and performance vehicles can vary significantly because of modifications, engine conversions, fabrication, previous repairs and other vehicle-specific differences.

Compatibility information should therefore be reviewed carefully before ordering.

If you are unsure whether a product suits your chassis, engine, vehicle configuration or intended use, contact Dorifab before purchasing.

Nothing in this section limits any rights available under applicable consumer law.

3. MOTORSPORT & PERFORMANCE USE

Some Dorifab products are designed for motorsport, competition, modified vehicles or performance applications.

It is the customer's responsibility to determine whether a product is suitable and lawful for the vehicle, intended use and jurisdiction in which it will be installed or operated.

Road-registration, motorsport, engineering, safety and modification requirements can vary between jurisdictions.

Where professional installation, engineering approval, certification or inspection is required, the customer is responsible for arranging it unless Dorifab has expressly agreed otherwise in writing.

4. ORDERS

Submitting an order does not necessarily mean that Dorifab has accepted the order.

We may decline or cancel an order where reasonably necessary, including where:

• a product is unavailable;
• pricing or product information contains an obvious error;
• payment cannot be processed;
• we cannot reasonably deliver the product to the nominated destination;
• the order appears fraudulent or unauthorised; or
• fulfilling the order would breach applicable law.

If we cancel an order after payment has been received, any amount owing to you will be refunded using the appropriate payment method.

Nothing in this section limits rights or remedies that cannot lawfully be excluded.

5. PRICING

Prices are displayed in the currency shown on the website.

Prices may change from time to time.

The price applicable to an order is generally the price displayed when the order is placed, subject to correction of obvious errors and applicable law.

Shipping charges, taxes, duties and other applicable charges may be calculated separately and displayed during checkout.

For international orders, additional import duties, taxes, brokerage or customs charges may be imposed by the destination country and may be payable separately by the recipient.

6. PAYMENT

Orders must be paid using a payment method made available through checkout unless another arrangement has been agreed with Dorifab.

Payment services may be provided by third-party payment providers and may be subject to their own terms and conditions.

Dorifab does not guarantee the availability of any particular payment method.

7. PRODUCT AVAILABILITY & LEAD TIMES

Product availability may change without notice.

Shelf Stock products, made-to-order products, custom products and special-order items may have different dispatch or production times.

Where a product page states a specific lead time or availability condition, that information applies to that product.

Unless expressly agreed otherwise in writing, production, dispatch and delivery timeframes are estimates rather than guaranteed completion or delivery dates.

8. SHIPPING

Shipping availability, costs, delivery addresses, tracking, international orders and transit issues are governed by our Shipping Policy.

Where product-specific shipping or freight conditions are shown on a product page, those conditions also form part of the order.

9. RETURNS & REFUNDS

Returns, exchanges, faulty products and refunds are governed by our Return and Refund Policy.

Our voluntary change-of-mind conditions do not limit consumer rights that cannot lawfully be excluded.

Australian consumers automatically receive consumer guarantees under the Australian Consumer Law, and contractual terms cannot remove those guarantees.

10. CUSTOM, MODIFIED & MADE-TO-ORDER PRODUCTS

Products manufactured, modified, configured or ordered specifically for a customer may be subject to additional conditions disclosed before or during purchase.

Custom or made-to-order products may not be eligible for voluntary change-of-mind returns once production, modification or procurement has commenced.

This does not affect rights relating to faulty or non-compliant goods under applicable consumer law.

11. CUSTOM SERVICES & PROJECT WORK

Engineering, fabrication, motorsport wiring, custom builds and other project-based services may be governed by a separate quotation, scope of work, invoice, project agreement or other written terms.

Where separate written project terms have been agreed, those terms apply to that project in addition to these Terms of Service.

If there is an inconsistency concerning the specific project, the expressly agreed project terms will apply to the extent of that inconsistency, subject to applicable law.

12. CHANGES TO ORDERS

If you need to change or cancel an order, contact Dorifab as soon as possible.

We cannot guarantee that an order can be changed or cancelled once it has entered production, been modified, been ordered from a supplier or been dispatched.

Any applicable refund or cancellation rights remain subject to consumer law and our published policies.

13. INSTALLATION & VEHICLE MODIFICATION

Unless installation is expressly included in the product or service purchased, Dorifab products are supplied without installation.

Products should be installed by a suitably competent person.

Installation of motorsport and performance components can affect other vehicle systems. Customers and installers should confirm appropriate fitment, clearances, fasteners, routing, fluids, electrical connections and other relevant factors before operating the vehicle.

Nothing in this section excludes liability that cannot lawfully be excluded.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of this website — including Dorifab branding, logos, graphics, photographs, product designs, written content and other original material — is owned by or licensed to Dorifab.

You may use the website for personal and legitimate commercial purchasing purposes.

You must not reproduce, distribute, sell, modify or commercially exploit Dorifab intellectual property without permission unless permitted by law.

Purchasing a Dorifab product does not transfer ownership of any underlying intellectual property rights.

15. CAD, DRAWINGS & ENGINEERING MATERIAL

Where Dorifab provides drawings, CAD files, technical documentation, designs or other engineering material, ownership and permitted use may also be governed by the relevant quotation, project agreement or written licence.

Unless expressly agreed otherwise, the supply of a finished product does not automatically transfer ownership of Dorifab's underlying design files, manufacturing data or intellectual property.

16. USER-SUPPLIED INFORMATION

You are responsible for ensuring that information you provide to Dorifab is accurate and complete.

This includes vehicle details, chassis information, engine configuration, measurements, technical data, delivery information and project requirements.

Dorifab is not responsible for issues caused solely by materially incorrect or incomplete information supplied by a customer, except to the extent responsibility cannot lawfully be excluded.

17. THIRD-PARTY PRODUCTS & SERVICES

Some products, services, payment systems, shipping services or website functions may be supplied or operated by third parties.

Third-party services may be subject to separate terms and policies.

Links to third-party websites are provided for convenience and do not necessarily constitute endorsement by Dorifab.

18. WEBSITE AVAILABILITY

We may modify, suspend or discontinue parts of the website where reasonably necessary.

We do not guarantee that the website will operate continuously or without technical interruption.

This does not affect any existing contractual or consumer rights relating to orders already accepted.

19. ERRORS & OMISSIONS

Occasionally the website may contain typographical errors, incorrect specifications, pricing errors or other inaccuracies.

We may correct errors and update information where appropriate.

Where an error affects an order already placed, we will deal with the order reasonably and in accordance with applicable consumer law.

20. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, Dorifab is not responsible for indirect or consequential loss arising solely from circumstances outside our reasonable control.

Any limitation in these Terms applies only to the extent permitted by applicable law.

21. AUSTRALIAN CONSUMER LAW

Our goods and services may come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms of Service is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

The ACCC confirms that businesses cannot remove consumer-guarantee rights through their contract terms.

22. PRIVACY

Personal information collected through the website is handled in accordance with our Privacy Policy.

23. CHANGES TO THESE TERMS

We may update these Terms of Service from time to time.

The version published on the website at the relevant time applies, subject to rights already acquired under an existing order or agreement and applicable law.

24. SEVERABILITY

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

25. GOVERNING LAW

These Terms are governed by the laws applicable to Dorifab's operations in Australia.

Nothing in this clause prevents a consumer from relying on rights available under laws that apply to them and cannot lawfully be excluded.
